Terms of Service.
These terms are the agreement between you and West Hills AI for using our platform. We've kept them readable — please read them before using the Services.

1. Acceptance
By creating an account or using westhillsai.agency or the client portal (the “Services”), you agree to these Terms and to our Privacy Policy, Acceptable Use Policy, and Subscription & Billing Terms. If you're using the Services for an organization, you confirm you're authorized to bind it.
2. Eligibility and accounts
You must be at least 18 and able to form a binding contract. You're responsible for the accuracy of your account details, for keeping your credentials secure, and for all activity under your account. Tell us promptly at contact@westhillsai.agency if you suspect unauthorized access.
3. The Services
West Hills AI provides AI agents, automation, a website builder, marketplace and studio tools, analytics, and IT support. We may add, change, or discontinue features over time. Some features depend on third-party providers (see the Privacy Policy) and on your maintaining an active plan.
4. Acceptable use
Your use of the Services must follow our Acceptable Use Policy. In short: nothing illegal, infringing, harmful, deceptive, or abusive, and no attempts to break, overload, or circumvent the platform's security or usage limits.
5. AI-generated content
The Services use AI models to generate text, websites, and other outputs from your inputs. AI output can be inaccurate, incomplete, or unsuitable for your purpose — you're responsible for reviewing it before you rely on or publish it. As between you and West Hills AI, you own the inputs you provide and the outputs you generate, subject to the terms of the underlying model providers (such as OpenAI) and to any third-party rights. Don't treat AI output as professional, legal, medical, or financial advice.
6. Plans and billing
Paid plans, one-time builds, and support passes are governed by our Subscription & Billing Terms, which cover renewals, cancellation, and refunds. Payments are processed by Stripe.
7. Your content and responsibilities
You retain ownership of the content and data you submit. You grant us the limited rights needed to host, process, and display it in order to operate the Services for you. You're responsible for having the rights to any content you upload and for how you use anything you publish (for example, a generated website you take live).
8. Our intellectual property
The platform itself — our software, design, branding, and documentation — belongs to West Hills AI. These Terms don't grant you any right to copy, resell, or reverse-engineer the platform, except as expressly allowed.
9. Third-party services
When you connect or use third-party services (Google, Zoom, Meta, Stripe, travel providers, and others), their terms and privacy practices also apply. We're not responsible for third-party services we don't control.
10. Disclaimers
The Services are provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. We don't warrant that the Services will be uninterrupted, error-free, or that AI output will be accurate or fit for a particular purpose.
11. Limitation of liability
To the fullest extent permitted by law, West Hills AI will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Services is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
12. Indemnity
You agree to indemnify West Hills AI against claims arising from your content, your use of the Services, or your violation of these Terms or applicable law.
13. Termination
You can stop using the Services and close your account at any time (see Account Deletion). We may suspend or terminate access if you violate these Terms or the Acceptable Use Policy, or to protect the Services. Sections that by nature should survive termination (ownership, disclaimers, liability, indemnity) will continue to apply.
14. Governing law
These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-laws rules. You and West Hills AI agree to the exclusive jurisdiction of the state and federal courts located in New Mexico for any dispute that isn't subject to arbitration or small-claims court, unless applicable law requires otherwise.
15. Changes
We may update these Terms; we'll revise the “last updated” date and, for material changes, notify you through the Services or by email. Continuing to use the Services after a change means you accept the updated Terms.
